Terms of Service
Effective date: October 3, 2026
Welcome to GigFlower. GigFlower is operated by Fluxel LLC, a California limited liability company ("Fluxel," "we," "us," or "our"). These Terms govern your use of the GigFlower website and services (the "Service"). When you affirmatively accept these Terms, you enter into an agreement with Fluxel LLC. If you do not agree, do not create an account or use the Service.
1. What GigFlower does
GigFlower helps musicians research potential venues, find contact information, customize a premade outreach email template, and organize their booking efforts. You choose whom to contact and review and send messages yourself. GigFlower does not send those outreach messages on your behalf.
A venue listing is a research lead. It does not mean the venue is affiliated with GigFlower, endorses the Service, is accepting booking requests, or has agreed to hire you. We do not negotiate or enter into performance agreements on your behalf.
2. Free open beta and future paid features
The Service is currently offered as a free open beta. It is still being developed and may contain errors, be interrupted, or change. We may modify or discontinue beta features or the beta itself. Where reasonably practicable, we will give advance notice of changes that materially affect your access or saved information.
We may offer paid plans or features in the future. Before you purchase, we will disclose the applicable price, billing arrangements, and payment terms. Participating in the free beta does not authorize any charge or automatically enroll you in a paid subscription. We do not promise that beta features will remain free indefinitely.
3. Eligibility and accounts
You must be at least 18 years old to use the Service. If you use it for a band, company, or other organization, you must have authority to act for that organization.
Provide accurate account information and keep your login credentials confidential. Promptly notify us if you believe your account has been accessed without authorization. You are responsible for your own use of the account and use you authorize; this provision does not excuse our own legal responsibilities.
4. Research results and outreach drafts
Venue information, contact details, and email templates may be inaccurate, incomplete, outdated, or unsuitable for your situation. Review them before relying on them or contacting anyone. Verify important details directly with the venue.
You are responsible for the messages you choose to send, including their accuracy, recipient selection, and compliance with applicable laws and the rules of the platform you use. Do not misrepresent your identity, experience, or relationship with a venue. Respect requests not to be contacted. A publicly listed contact address does not by itself establish permission for every form of outreach.
We do not guarantee responses, bookings, recurring performances, payment, or income.
5. Acceptable use
Do not use the Service to harass, threaten, defraud, impersonate others, infringe intellectual property or privacy rights, or facilitate unlawful or abusive messaging. Do not attempt unauthorized access, introduce malicious software, interfere with the Service, or evade security controls or usage limits.
6. Your content and our Service
You retain your rights in the profiles, bios, images, and other material you submit. You grant Fluxel a nonexclusive permission to host, store, process, reproduce, and display that material only as reasonably needed to provide and maintain the Service, as described in our Privacy Policy. This does not give us ownership of your music or permission to use it in unrelated advertising. You must have the rights necessary to submit the material.
Fluxel and its licensors retain their rights in the Service's software, branding, and original site content. These Terms allow you to use the Service for its intended purpose. They do not transfer ownership of the Service or of third-party venue information. You may edit and use the outreach drafts supplied to you, subject to applicable law and third-party rights; we do not guarantee that drafts are unique or eligible for copyright protection.
7. Your arrangements with venues
You and the venue are responsible for your communications and any performance agreement, including rates, schedules, cancellations, permits, and payment. Fluxel is not a party to those agreements and does not guarantee either party's performance. This section does not exclude responsibility for Fluxel's own conduct where applicable law imposes it.
8. Privacy and security
Our Privacy Policy explains how we collect, use, share, and retain personal information.
We will maintain security measures appropriate to the information we handle and applicable legal requirements. However, no online service or storage system can be guaranteed completely secure. Nothing in these Terms waives our applicable security or breach-notification obligations or your rights that cannot legally be waived.
9. Availability and disclaimers
To the extent permitted by law, the beta Service is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not warrant uninterrupted or error-free operation, complete or accurate research results, or achievement of any particular outcome.
Keep your own copies of important contacts, drafts, and booking records. The beta should not be your only record of a booking commitment. These disclaimers do not exclude warranties or protections that applicable law does not permit us to exclude.
10. Exclusion of monetary liability
To the maximum extent permitted by applicable law, Fluxel LLC will not be liable for monetary damages arising out of or relating to the free beta service or these terms, whether direct, indirect, incidental, special, consequential, exemplary, or punitive, including damages for lost profits, lost business opportunities, loss of data, or service interruption. This exclusion applies whether a claim is based on contract, tort (including ordinary negligence), or another legal theory, even if Fluxel has been advised of the possibility of such damages.
This exclusion does not apply to fraud, willful misconduct, gross negligence, or any liability that applicable law prohibits us from excluding. Nothing in these Terms waives nonwaivable consumer rights, statutory remedies, or legal duties. If this exclusion is unenforceable for a particular claim, applicable law determines the available remedies; these Terms do not establish a substitute dollar cap.
11. Suspension and ending use
You may stop using the Service at any time and request account deletion using the contact information below. We may restrict or suspend access for material violations of these Terms, security risks, unlawful activity, or discontinuation of the beta. Where reasonably practicable, we will explain the reason and provide an opportunity to address it; immediate action may be necessary to protect users or the Service.
Retention and deletion of personal information are described in our Privacy Policy and remain subject to applicable law. Provisions concerning ownership, disclaimers, liability, and disputes survive termination to the extent relevant to events occurring while you used the Service.
12. Changes to these Terms
We may update these Terms as the Service develops. We will update the effective date and provide reasonable advance notice of material changes, except where an urgent legal or security reason requires earlier action. We will obtain renewed agreement where required by law. Changes will not retroactively alter rights concerning a dispute that arose before the change. If you do not agree to revised Terms, you may stop using the Service.
13. Governing law and disputes
California law governs these Terms, without regard to conflict-of-laws rules, except where applicable law requires otherwise. Nothing here deprives you of mandatory protections or the right to bring a claim in a court available to you under applicable law. These Terms do not require arbitration or waive class actions.
You may contact us to try to resolve a concern informally, but doing so is not a prerequisite to exercising your legal rights. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
